Terms of Service
Last updated: [DATE]. Draft: have this reviewed by a solicitor before relying on it.
1. Who we are
FoodOnTheLine is operated by [LEGAL BUSINESS NAME], [ADDRESS] ("we", "us"). Contact: carl.worrall42@gmail.com. These terms apply to businesses ("you") that use our automated phone ordering service.
2. The service
We provide an automated phone line that answers calls to your restaurant or takeaway, takes orders, and sends them to you by the alert channels agreed in your quote (for example email, printer, tablet or SMS). Callers can press 0 to reach your team. Some features, such as a website or app, are extras and are priced separately.
3. Fees and payment
Fees, what they include, and who pays telephone and usage costs are set out in your written quote: [Setup fee, monthly fee, usage costs, VAT, payment terms.] We don't charge commission on your orders.
4. Term and cancelling
[State the minimum term, if any, and the notice needed to cancel.] When you leave, we switch off the line, you switch your call forwarding back, and we export your data to you on request.
5. Your responsibilities
- Give us an accurate menu, prices and opening hours, and tell us promptly about changes.
- Keep your alert devices (printer, tablet, phones) working and switched on.
- Allergies: the service records allergy and special requests as the caller states them. You remain responsible for checking and confirming allergy information before preparing food.
- Tell your callers how their data is used, as the restaurant is responsible for that relationship (see our Privacy Policy).
6. Availability
We aim to keep the line running at all times, but we can't promise uninterrupted service. If the line is unavailable, calls are forwarded to your phone. Failures of phone networks, internet or other providers are outside our control.
7. Data
Your customer and order data belongs to you. How we handle personal data is set out in our Privacy Policy.
8. Liability
Nothing in these terms limits liability that can't legally be limited, including for death or personal injury caused by negligence, or for fraud. [Add a reasonable cap on other liability, reviewed by a solicitor.]
9. Changes and law
We may update these terms and will tell you in advance of material changes. These terms are governed by the laws of [England and Wales / Scotland].
